Range of Experience
Extensive experience in forensic accounting, fraud examination, damage calculations and accounting malpractice. Previous assignments have included identification of bankruptcy preference payments, fraudulent conveyance analysis for both creditor committees and receivers, and claims analysis including profiteer determination. Expert deposition and trial testimony in fraud, damages and profiteering matters.
Complex forensic investigation into a $220 million factoring fraud, including tracing funds through various entities' accounts. Reviewed the audit work papers and re-audited several years of accounts receivables to develop a foundation for the accounting malpractice claim. Consulted with attorneys regarding elements of accounting malpractice, areas to be investigated in deposition, and trial exhibits. Case resulted in a jury verdict of $170 million in compensatory damages.
Performed an investigation and provided expert testimony in a bank fraud case against four financial institutions for failure to detect check-kiting involving a lumber distribution company. Gathered evidence to support $200 million fraud.
Conducted a forensic investigation of a failed real estate condominium conversion and related $10 million unregistered REIT. Performed detailed financial asset tracing analysis identifying assets for recovery including reconstruction of REIT financial records. Provided consulting services to counsel during discovery and trial. Also, prepared claims analysis.
Supervised investigations on behalf of an FTC receiver on scam telemarketing schemes (copying toner, cell art and college scholarships). Participated in initial seizures, securing assets and records, and preparing reports and schedules. Testified as federal witness in fact and listed as receiver's expert witness.
Fraud examination of a voter petition drive for a major gaming corporation. Created and implemented methodology to quantify the petitions collected and verified. Testified as expert in state court.
Acted as rebuttal expert in breach of contract case for lost profits involving defective products.
Engaged as an expert witness for the Assistant U.S. Attorney in a civil forfeiture case. Analyzed financial data, prepared trial exhibits and provided expert testimony in Federal Court regarding seizure of real estate. Court ruled in favor of the U.S. Justice Department.

Organized an accounting malpractice case against a large national accounting firm. Identified and documented the departures from GAAP, violations of GAAS and assisted counsel in incorporating them into sections of the complaint. Consulted with attorneys regarding selection of expert witnesses and depositions.
Served the FDIC as a consultant on a professional negligence case involving audit failure where an accounting firm failed to disclose fraudulent and illegal loans.
Consulted with a bank holding company in a special management advisory service engagement. Analyzed document flow and reconstructed departments and manuals to increase efficiency.
Appointed by state court to determine gross sales in a case involving disputed employee remuneration. Testified regarding the proper sales commissions outstanding.
Investigated a case involving an insurance company's refusal to pay for fire damages that destroyed an accounting office and its records. Conducted detailed interviews with partners and employees and reconstructed the time sheets.
